1. General Terms of Trade
In addition to such of our General Terms of Trade as we reasonably deem applicable to website orders (“online sales”) the following Terms of Trade apply to online sales including shopping and participation in promotions run by us. You can access our General Terms of Trade at any time at the bottom of any page of our website. We shall be the sole judge of which of our General Terms of Trade are reasonably applicable to any online sale.
Your personal details and account information will be kept confidential by us. We will not divulge your email address or send you emails except for those dispatched from our emailing list unless you agree to it. You have the right to access and modify for correction purposes only any account information or personal details which is held by us. If you wish to be removed from our emailing list please use the “unsubscribe” link in the email. This will not affect order confirmation emails, which will be sent to you online every time you place an order.
3. Purchasing Online
Products displayed on our website shopping areas can be purchased using a secured payment gateway transaction facility online using Visa or Mastercard. You can be confident that as far as practicable all of your details are protected by security mechanisms and are used only for the purposes of the transaction. We do not store any credit card details. In order to complete a purchase online you have the option to register an account for use in future orders. By registering an you will be able to opt to receive regular emails.
4. Capacity of Purchaser
Orders can only be placed with us by persons with capacity to contract i.e. who are over the age of 18 years.
Payment for all online sales is by credit card (Visa or Mastercard), internet banking and Farmlands Card. Orders are subject to payment verification and acceptance before they are shipped.
All prices on our website are in New Zealand dollars and are plus NZ Goods and Services Tax (“GST”) at the rate applicable from time to time (if any). The total cost of your purchase including delivery costs will be shown in your local currency on your credit card statement. Your credit card provider will set the exchange rate on each transaction in accordance with that credit card provider’s policy from time to time. We will not be liable for any currency fluctuation on conversion of our New Zealand Dollar prices to another currency. Credit Card transactions are processed in New Zealand. Some Banks and credit card providers may charge an overseas transaction fee and/or foreign currency exchange fee for purchases made from outside New Zealand.
Products sold by us may be covered by the Consumer Guarantees Act 1993 (New Zealand) where applicable. Any dispute that may arise in relation to such goods will be determined by the Courts and Tribunals of New Zealand in terms of New Zealand law and the lodgement of your order with us will be treated as your acceptance that the law governing your contract and/or other matters with us or relating to us and/or to any of our products or services, will be the laws of New Zealand.
8. Returns & Exchanges
Our products are designed and manufactured with great care and we hope you are pleased with them. Nevertheless, if for any reason you are not satisfied with any of our products supplied to you by us, then if the products are unused and in the original packaging with labels attached and are returned to us within 7 days of your receiving the products we will at our discretion refund or exchange them for you as appropriate. Please note we are not responsible for return delivery costs other than for incorrect or faulty items and we will not be responsible for shipments that fail to reach us, so please obtain a Certificate of Shipping as proof of shipment to us.
While we will make every effort to fill orders promptly we reserve the right to decline orders without disclosing the reason for doing so. We will not be liable for failure to deliver by an expected time whether the delay has been due to causes beyond our control or otherwise. If you have for any reason provided the wrong delivery address and/or zone then we reserve the right to correct the delivery address and/or zone and charge you by addition the correct delivery fee without prior confirmation, so please make sure that you do select the right delivery zone. If the carrier’s first attempt at delivery is unsuccessful you may be contacted to arrange alternative collection.
Our Couriers do not deliver to PO Boxes. All packages MUST be signed for at delivery time or you may contact the Courier to arrange a pickup from a central dispatch point.
10. Use of Online Service by You
Your right to use our online service is personal to you. You may not authorise others to use the service and you are responsible for your own use of the service. The service’s content information and advice is free of charge (unless otherwise stipulated). You are responsible for your own network and connection charges.
11. Vendor’s Copyright
All content on our site including text, images etc are our property and are protected by copyright law and/or Trade Mark Registration. No part of the site may be copied, sold or used in any manner without our prior written consent.
Our service provides general information about us and our products and services. Information contained in the service has been prepared solely for the purpose of providing general information about us and our products. We reserve the right to change, delete or move any of the material on our service at any time without notice.
We shall not be liable to you or any third party for any direct, indirect, special, consequential or punitive damages allegedly sustained arising out of your access to or inability to access our online service. This includes viruses alleged to have been obtained from this service, your use of or reliance on the service or any of the information or materials available on the service regardless of the type of claim or the nature of the cause of action.
Headings used in these Terms, are for convenience only, and are not to be taken into account in the interpretation of these Terms.
